Terms of Service

1. Acceptance of Terms

By accessing or using the Final Bark platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Final Bark.

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. We will notify registered users of material changes via email.

2. Service Description

Final Bark is a software-as-a-service (SaaS) platform designed for contractors in the trades industry. The Service provides tools for:

• Creating and managing change orders for construction and trade projects.
• Collecting legally binding electronic signatures from clients under the ESIGN Act.
• Generating PDF records of signed change orders for documentation and dispute prevention.
• Team management, analytics, and other business tools as described on our platform.

Final Bark is a documentation and communication tool. We are not a law firm and do not provide legal advice. Consult a qualified attorney for specific legal questions regarding your contracts or disputes.

3. User Accounts

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized access to your account.
• Ensuring that all information you provide is accurate and up to date.

You must be at least 18 years old to create an account. By creating an account, you represent that you have the legal capacity to enter into these Terms.

4. Billing & Payments

Final Bark offers a free tier and a paid Pro tier. By subscribing to the Pro plan, you agree to the following:

• The Pro plan is billed at the rate displayed at the time of subscription (currently $49/month or $39/month billed annually at $468/year).
• Payments are processed securely through Stripe. You authorize Stripe to charge your provided payment method on a recurring monthly basis.
• You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing cycle.
• Refunds are available within the first 30 days of your initial Pro subscription. After that period, no refunds are issued for partial months.
• We reserve the right to change pricing with 30 days' advance notice to existing subscribers.

5. Intellectual Property

The Final Bark platform, including all software, design, text, graphics, logos, and other content, is owned by Final Bark and protected by intellectual property laws.

Your content: You retain ownership of all data, change orders, and content you create on the platform. By using the Service, you grant Final Bark a limited license to store, process, and display your content solely for the purpose of providing the Service.

You may not copy, modify, distribute, or reverse-engineer any part of the Final Bark platform without prior written consent.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Create fraudulent change orders or forge electronic signatures.
• Interfere with or disrupt the Service or servers.
• Attempt to gain unauthorized access to any part of the Service.
• Use the platform for any purpose other than legitimate business documentation.

7. Limitation of Liability

To the maximum extent permitted by law, Final Bark shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Final Bark's total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to Final Bark in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

8. Termination

You may terminate your account at any time by contacting support or using the account settings in your dashboard.

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or fail to pay subscription fees. We will provide reasonable notice before termination when possible.

Upon termination, your right to use the Service ceases immediately. You may export your data (including PDF change orders) prior to account deletion. Certain records, including signed electronic documents, may be retained as required by law.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
